That's most of the people that get pissed off at skateboarders.

It's always some random person going out of their way to stir up a confrontation. Usually skaters go out of their way to avoid crowded places. These middle aged Grey knights see them and feel the need to go get excessively angry.

Hell I remember some guy approaching me at the SKATE PARK threatening to call the cops on us for "having no regard for public safety". Literally in a fenced in skatepark.

Wish old people could redirect their hatred to shooters and other criminals rather than kids who ride a piece of wood with wheels.

So, it's kinda funny that it sort of aligns. Fudd, short for Elmer Fudd the dopey hunter, is used as a sort of pejorative in the firearm community to malign a certain type of firearm owner, typically of the older variety. The defining characteristics are a general attitude of rejecting most modern aspects of firearms and accessories, saying things like "9mm is too weak and doesn't have the StOpPiNg pOwEr of the Colt 'fourteefive' 1911", declaring that no one needs an AR-15 and that shotguns/hunting rifles are all that matter to them, or generally being shitty and elitist towards new shooters who don't perfectly subscribe to their above stated beliefs.

It's always very satisfying to get a person like this arrested. Simple call to the police should do. I love the naked arrogance, and cowboy demeanor of people like this. It may be a lack of IQ, or they may be deluded in self importance, but I friggin love when someone casually breaks the law to try and get a leg up on someone else or intimidate, and doesn't even think about the possible consequences waiting for him in the future. The skater dude was super calm and collected, almost, like a man who knew a less rational man could easily be baited into bad behavior. I bet these dudes had a previous run-in with Taint Eastwood and were like, "next time he comes riding in on his tesla, have the camera rolling". Homie just brandished. You don't get to draw your sidearm on a whim, you must have actual cause (aka: immediate threat to you or those around you).

That is a really good way to not only get arrested, but killed. If you draw a weapon, then you are also fair game to anyone else around you who now - in accordance with the law - view you as a threat and may respond in kind.

Just FYI, CCW trainers under legal advice will tell you to draw and fire without hesitation. If you’re not intending to shoot, don’t draw the gun. But if you do draw the gun, shoot. It helps your argument that you felt under immediate danger for your life.

Guns should not be used to de-escalate a situation. The act of drawing the gun in fact escalates the situation. But if your life is in danger, you shoot to stop the threat.

But this guy is a fucking psycho; he’s lucky there wasn’t a third kid around to cave in the back of the head with a skateboard truck.

When I was an RSO and assisting with CWP, we drilled into people that if you pull, you pull. Very rarely is simply drawing down going to solve an issue... if it was bad enough for you to unholster, you better be ready for all the consequences that follow. And there are bunches -- not just legal but the mental impact of potentially ending someones life. Not something to enter into lightly.

I wish more people understood the gravity of what carrying a firearm really entails. One of the reasons I got out of the hobby was all the crazy assholes getting more and more brazen.

There were a refreshing video awhile back that I can’t seem to find.

Kids skateboarding in a private business parking lot and they start recording what looks like a Karen on a mission walking towards them.

They are all recording while trying to figure out what her deal was; she had the haircut, sunglasses and a clipboard.

Turns out, she just wanted to warn them that some big trucks were going to come into the parking lot soon to setup some event. She just wanted to ask that when the trucks come in if they could move to the other side of the lot so they don’t get hit by a truck when they are backing trailers in.

If you're in immediate danger (he draws and points his firearm at you unprovoked) and you shoot him in self defense chances are you will not go to jail, depending on the state. Some states are more self-defense friendly.

The problem is that you shouldn’t be pulling your gun on someone unless you feel like you are in immediate danger of your life or serious harm.

So for this particular scenario you’re speaking to, the person who lived in the end would probably get arrested and would then have to plead his case. He would have to prove that he get that his life was in danger, this could be because the other guy said “I’m going to fucking kill you” or “I’m going to shoot you right now” or something song those lines.

For instance, if I were in a convenience store and some guy walked up to me and told me he’s gonna kill me with the gun is his pocket, I could potentially be in the clear to stop that immediate threat to me.

The difficulty with your scenario is that there were no witnesses or audio and both drew their weapons at the same time. That makes the evidence pretty muddy, and the only “evidence” available is the word of the guy who lived. At that point it’s up to the prosecutor to try to charge for the a crime, and if they did get charged, up to the judge/jury to decide if that person acted in self defense because they feared for their life or if that person murdered the other person over the last chocolate bar.

This is pretty spot on.

To add on to this, in the U.S. when someone kills another human it is a homicide no matter the details of the case.

This then leads into if the presiding jurisdiction believes it was or was not lawful/malicious/misconduct at face value and decides to press charges for unlawful homicide ie. murder/manslaughter.

If you believe it was justified you then proceed to argue an affirmative defense, self-defense in this scenario.

Interesting thing about affirmative defenses (to me at least) is that it changes a court case fundamentally in a legal sense. In a standard criminal case the legal burden of proof relies upon the prosecutor. When an affirmative defense is invoked, the burden of proof relies upon the defendant and their counsel.

This in essence changes the defendant from innocent until proven guilty to guilty until proven innocent.

If you have a murder case and the defendant invokes self-defense, the prosecutor for the duration of the trial could essentially not say anything, ask zero questions, provide zero evidence, and you could be found guilty of the charges.

It depends on the state. In NY you have to run away and “retreat” from the danger before you can defend. Even if he wasn’t the first to pull the gun, shoots and kills the guy, he’s doing time if he didn’t try to retreat first. I don’t agree with it, but some states just don’t have good self defense laws.

Remember that duty to retreat doesn't mean you have to run away. It means that you must make an effort to secure yourself somewhere out of a direct line of fire and assess the situation before counter operations can take place if said action does not further increase your risk of injury.

If you are standing in a parking lot, with no where to go - there is no retreat possible. You've already exhausted that possibility as it is not feasible to try and just run away in an open area and take a round to the back. You are clear to initiate any other defense - up to and including using your own weapon - to prevent injury to yourself or those around you.

Remember folks: Better to be judged by 12 than carried by 6.

Generally even in duty to retreat states, you only have to attempt to retreat if it's possible to do so safely. If the other guy has pulled a gun, that's not a safe option.

Here in the US it largely depends on the state you're in due to their differing gun and self defense laws. You would legally be able to shoot him if he pointed the gun at the you in any state, but just because he illegally brandished the gun doesn't give someone here the right to immediately gun him down. Only if they have a reasonable fear that the guy was about to use deadly force on them or someone else
